These Terms of Service ("Terms") govern your access to and use of the Maternly website at maternly.ca, including its tools, content, and email reminder service (together, the "Service"). By using the Service or subscribing to our emails, you agree to these Terms. If you do not agree, please do not use the Service.
Maternly provides general informational and educational content and tools designed to help mothers in Canada understand topics such as parental leave, employment benefits, and postpartum preparation. The Service is intended as a starting point and a convenience.
The Service does not provide medical, legal, financial, tax, or other professional advice, and it is not a substitute for advice from a qualified professional. Content was not prepared by licensed physicians, lawyers, financial advisors, or government agencies. No professional relationship is created between you and Maternly by your use of the Service.
You should always consult a qualified professional โ including your own healthcare provider โ and confirm details with official sources such as the Government of Canada before making any decision that affects your health, finances, employment, or legal rights.
We make reasonable efforts to reference reliable sources, including publicly available government information. However, laws, benefit amounts, eligibility rules, and other details change over time and vary by individual circumstance and by province or territory.
We do not warrant or guarantee that any information provided through the Service is accurate, complete, current, or applicable to your situation. Any calculations, estimates, or results produced by our tools are illustrative only and may differ from official determinations.
Our reminder emails are timed around information you provide, such as a due date, and are sent for general guidance only. They may arrive late, early, contain errors, or no longer reflect current rules. Subscribing is entirely voluntary, you are never obligated to act on any reminder, and you may unsubscribe at any time using the link in any email or by contacting us. Reminders are not a monitoring, medical, or emergency service and should never be relied upon as such.
Your use of the Service, and any decision you make based on it, is voluntary and made at your own discretion and risk. You are responsible for verifying any information that matters to you and for the choices you make.
The Service may link to or rely on third-party websites and tools (for example, government pages, email delivery providers, or chat services). We do not control and are not responsible for the content, accuracy, or practices of any third party. Links are provided for convenience and do not imply endorsement.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by applicable law. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the fullest extent permitted by applicable law, Maternly and the individuals operating it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, income, or profits, arising out of or relating to your use of (or inability to use) the Service or your reliance on any content or reminder, whether based in contract, tort, negligence, or any other legal theory.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for fraud or for death or personal injury caused by negligence where such limitation is prohibited by law.
You agree to indemnify and hold harmless Maternly and its operators from any claims, losses, or expenses arising out of your misuse of the Service or your violation of these Terms, to the extent permitted by applicable law.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; the "Last updated" date above reflects the most recent version. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
